Official definition of cosmetics

The Federal Food, Drug, and Cosmetic Act (FDA&C Act) defines cosmetics as "items that are wiped, poured, sprayed, introduced, or otherwise applied to the human body for the purpose of 

cleaning, beautifying, enhancing attractiveness, or changing appearance" [FD&C Act, sec. 201 (i)]. Products that meet this definition include skin moisturizer, perfume, lipstick, nail polish, eye and facial cosmetics, cleaning shampoo, hair dye, deodorant, and any substance used as a cosmetic ingredient.

1.&FDA Voluntary Cosmetic Registration Program (VCRP)

The FDA Voluntary Cosmetic Registration Program (VCRP) provides cosmetic manufacturers, packers, and distributors in the US market with the opportunity to submit their cosmetic business registration information (Form FDA 2511) and product filing information (Form FDA 2512). VCRP assists FDA in fulfilling its responsibility for cosmetics regulation. The FDA uses this information to evaluate cosmetics on the market.

Obtain important information on cosmetic ingredients.

The FDA will input all information obtained from VCRP into a computer database. If a certain cosmetic ingredient currently in use is deemed harmful and should be banned, the FDA will notify the manufacturer or seller of the product through the contact list in the VCRP database. If your product is not in the registration database, the FDA will not be able to notify you.

2. To avoid product recall or import detention due to ingredient issues.

If a cosmetics manufacturer files their product formula with VCRP, the FDA will alert the manufacturer to use unapproved color additives or other prohibited ingredients in the formula. In this way, manufacturers can modify the product formula before importing or selling, thereby eliminating the risk of product recall or detention due to improper use of ingredients.

3. Assist retailers in identifying manufacturers with safety awareness.

Retailers (such as department stores) sometimes inquire with the FDA whether a cosmetics company has been registered with the FDA. Although registration does not necessarily mean FDA approval, it indicates that your product has undergone FDA review and entered the government database. If the product formula you submit is incomplete, or contains a prohibited ingredient or unapproved pigment additive, the FDA will notify you.

FDA registration for cosmetics is not mandatory, but with the advent of the e-commerce era, the sales channels for enterprise products have become increasingly diversified.
