Introduction

UKCA stands for UK Conformity Assessed. On February 2, 2019, the UK government announced that it would adopt the UKCA marking scheme in the event of a no deal Brexit, and after March 29, trade with the UK would be conducted in accordance with World Trade Organization (WTO) rules. The UKCA mark, like the CE mark, is the responsibility of the manufacturer to ensure that the product complies with legal standards, and after making a self declaration according to the prescribed procedures, to make the corresponding mark on the product.

Most products currently within the scope of CE marking control must bear the UKCA mark if they are to be exported to the UK market (England, Wales, and Scotland) in the future. The UKCA mark is not applicable to products entering Northern Ireland.

Certification background

The UK is currently in a transitional period for Brexit, which will end at the end of 2020. On September 1, 2020, the UK Department for Business, Energy and Industrial Strategy officially announced on its official website that the UKCA logo will be used from January 1, 2021.

At present, most products covered by the CE mark will also fall within the scope of use of the UKCA mark. It will also be applicable to aerosol products.

Starting from January 1, 2021, products that require CE marking in the EU market entering the UK market must have the UKCA marking, manufacturer's conformity declaration, and complete conformity assessment technical documentation. The requirements of the UKCA Declaration of Conformity (DoC) are also equivalent to the EU CE marking Declaration of Conformity, but the corresponding British BS standard must be used on the DoC and declared to comply with UK regulations.

As a transitional period, products with the same technical requirements and labeling rules as the UK and EU can still accept CE labeling before January 1, 2022. But if there are changes to the CE marking rules for the product during this period, the CE marking made according to the new EU rules will not be accepted by the UK market. Therefore, it is recommended to transition to using the UKCA logo as soon as possible.

The UKCA logo covers products, but there are some special rules:

UKCA tag usage issues

If a mandatory third-party conformity assessment has already been conducted by an EU accredited conformity assessment body, or if a certificate of conformity previously issued by a UK agency has been moved to an EU accredited conformity assessment body, manufacturers can still use the CE mark to sell their products in the UK market. If the original use was by a UK notified body and the conformity assessment file has not been transferred to an EU notified body by January 1, 2021, the UKCA mark must be immediately used from January 1, 2021 and the CE mark will no longer be accepted.

Products that have been produced and put on the market before December 31, 2020 can still be sold in the UK market using the existing CE mark.

The UKCA mark will not be recognized in the EU market, and products that currently require the CE mark still require the CE mark for sale in the EU.

Products considered to be within the scope of mandatory regulatory control must have the UK Conformity Assessment (UKCA) mark after December 31, 2020, in order to enter the UK market, and must contact a third-party organization recognized by the UK.

Before January 1, 2023, except for products subject to special rules, the UKCA logo and related importer and manufacturer information can be marked on the product body or on the accompanying product documents. After January 1, 2023, it can only be marked on the product body.

UK Declaration of Conformity

The UK Declaration of Conformity is a document that must be drafted for the majority of legal products bearing the UKCA logo.

In the document, as the manufacturer or your authorized representative (as permitted by relevant legislation), you should:

·Declaration that the product complies with the relevant legal requirements applicable to a specific product

·Ensure that the document contains the name and address of the manufacturer (or your authorized representative), as well as information about the product and the conformity assessment agency (if relevant)

Upon request, provide the UK conformity declaration to the market supervision agency.

The information required for the conformity declaration will be largely the same as the information currently required for the EU conformity declaration. This may vary depending on the application regulations, but typically should include:

·Your name and complete business address or authorized representative's name and complete business address

·Product serial number, model or type identification

·Declaration, declare that you take full responsibility for the compliance of the product

·Detailed information of the approved agency performing the qualification assessment procedure (if applicable)

·Relevant regulations that the product complies with

·Your name and signature

·Declaration release date

·Supplementary information (if applicable)
